If you don't have a will...

... you may be labouring under the misapprehension that your property and other assets will pass on to your nearest and dearest in the event of your death. Consequently, you may believe the writing of a will is unnecessary in light of this 'default position'.

Unfortunately, things are a little more complicated than that. If you die 'intestate' - that is, having not made a will - your assets will be divided amongst your family in accordance with rules laid down by Parliament. The way in which these 'rules' divide your assets is inflexible and may not necessarily reflect your thoughts and feelings with regard to 'who gets what'. Sometimes, this can leave the people you care for most in a difficult position, financially.

Particular care also has to be taken when it comes to the often contentious area of 'guardianship'. That is, who will look after your children in the tragic event that both yourself and your partner pass whilst your children are still considered 'minors'.
